To provide our services, sell goods and operate our website, we process some personal data.

The processing of personal data is governed in particular by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) ("GDPR").

 

I. Processing of personal data

A.                        Processing of personal data when using the contact form

 

If you enquire about our products and services, we will work with the contact details you provide us, mainly via the enquiry form. These are: your name, surname, e-mail, telephone number, your requirements regarding our products and services, or any other data that you fill in the enquiry form or provide to us as part of further arrangements. 

What is the reason?

We will contact you through them for further arrangements regarding goods and services.

On what legal basis?

This is processing based on Article 6(1)(b) GDPR - contract negotiation and performance.

How long will we process the personal data?

Unless we establish further cooperation, we will process your data for a maximum of 6 months from our last communication. 

 

  1. Processing of personal data in case of purchase

If you make a purchase with us, we will work with the data you fill in. These are mainly billing data: name, surname, email, telephone number, address and details of your purchase. 

What is the reason?

We need to process personal data to fulfil our contract - to deliver the goods you have purchased. We will also communicate with you via the contact details regarding the status of your order, or regarding complaints or your queries. 

We will also process personal data to fulfil our legal obligations (mainly for accounting and tax purposes, or to deal with complaints and other matters).

On what legal basis do we process personal data?

This is processing based on Article 6(1)(b) GDPR - performance of a contract and Article 6(1)(c) GDPR - performance of our obligations.

How long will we process personal data?

For the duration of the performance of our service and thereafter for 10 years from the last time such service was provided or goods were supplied.

 

  1. Verification of reviews

If you have purchased from us and left a review, we can verify in the system (where possible) that you are indeed our customer and the review relates to the actual products and services purchased.

What is the reason?

Consumer protection regulations (in particular the Consumer Protection Act) require that if we communicate a review as authentic (from our customer), we must reasonably verify such review.

On what legal basis do we process personal data?

This is processing on the basis of Article 6(1)(c) of the GDPR - the performance of our obligations.

How long will we process the personal data?

For as long as we have the review in our marketing materials/on our website..

 

  1. Newsletters and SMS (commercial communication)

If you sign up for our newsletter or are a purchasing customer and did not opt-out when you made your purchase, we may use your email address and phone number to send you our newsletter.

On what legal basis?

In the case of newsletter subscription, the processing is based on your consent, i.e. on the basis of Article 6(1)(a) GDPR. 

If you are a purchasing customer, we are permitted to do so by Section 7(3) of Act No. 480/2004 Coll., on certain information society services, unless you have prohibited us from doing so at the time of purchase.

Consent is voluntary and revocable at any time. 

How long will we process personal data?

For 2 years after consent has been given or since the last purchase. You can unsubscribe from the mailing at any time by emailing us or contacting us at the details above. We will look into it.

 

E.       Analytics

We also use data about your purchase (what you bought, when, under what conditions) for analytical purposes. Based on this data, we know what goods to buy, where to strengthen our services, where to "cut back", what to expect economically in future periods. In short, we need data to manage and develop our company properly.

On what legal basis?

This is processing on the basis of Article 6(1)(f) GDPR - processing on the basis of so-called legitimate interest.

How long will we process the personal data?

For a period of 12 months, after which we anonymise the data for these purposes or do not process it further. You can lodge an objection to such processing. If applicable, please contact us at the above-mentioned contacts.

F. Analytics and ads targeting

If you have given us consent on our bar, we also work with your phone and email for analytics, tracking and advertising targeting purposes, including using (and linking tools to) Google.

On what legal basis?

This is processing based on your consent, i.e. based on Article 6(1)(a) GDPR. Consent is voluntary and revocable at any time.

How long will we process the personal data?

For a maximum of 1 year, unless you extend or withdraw your consent.

 

  1. Sending your CV

If you are responding to our open position and sending us a CV for the selection process, we process the personal data from this CV and your contact details for the purposes of the selection process.

On what legal basis?

This is processing on the basis of Article 6(1)(b) GDPR - contract negotiations and cooperation.

How long will we process the personal data?

Until the end of the selection procedure. After the end of the tender, we will only continue to process personal data if we agree with you on further cooperation or if you give us your consent to do so.

 

  1. Who has data access?

Your data will stay with us. However, we do have some companies or individuals working for us who get access to the data because they help us run our company. These are:

companies involved in the dispatch of payments (ComGate, GoPay, Paypal)

- companies involved in the dispatch of goods (Messenger, Liftago, Lahůdky Brno)

- e-mailing service provider (Webkomplet)

- suppliers of marketing, IT, analytical services

- providers of accounting, legal and other consulting services

- software providers (Supportbox)

 

  1. User account

If you have registered for our user account, we will process your personal data on the basis of your consent, i.e. in accordance with Article 6(1)(a). Consent is entirely up to you, it is voluntary.

To set it up, we process the personal data you fill in the registration form - name, email address.

As part of the account management, we store data about your orders on our e-shop and the personal data you fill in for your profile, i.e. name, surname and delivery address.

We will use the personal data to maintain your account and provide you with services for as long as you use your account. We will deactivate your account and delete the data if you do not use your account for more than 5 years after your last purchase. You can also deactivate your account (i.e. withdraw your consent to the processing of personal data) at any time. In this case, your personal data will be deleted.

Our company does not have a designated data processing officer.

The GDPR gives you the right, among other things, to contact us and request information about what personal data we process about you, to request access to that data and have it updated or corrected, or to request a restriction on processing, to request a copy of the personal data we process, to request that we erase your personal data in certain situations, and to request data portability in certain cases. Consents granted are revocable at any time and you can object to processing on the basis of legitimate interest. 

If you believe that we are not handling your data correctly, you have the right to lodge a complaint with the Data Protection Authority or take your claims to court.
